USSC: Stop Doing That – Texas: Bite Me

Nothing like a little Fort Sumter-style action to brighten my day:

The Texas National Guard continued to install razor wire along the U.S.-Mexico border on Tuesday after the U.S. Supreme Court ruled that the Biden administration could cut through or remove the razor wire.

“The Texas Military Department continues to hold the line in Shelby Park to deter and prevent unlawful entry into the State of Texas,” Texas said in a statement. “We remain resolute in our actions to secure our border, preserve the rule of law, and protect the sovereignty of our State.”

To make it quite clear:

“The State of Texas, under Gov. @GregAbbott_TX ’s Operation Lone Star, will maintain its current posture in deterring illegal border crossings by utilizing effective border security measures – reinforced concertina wire & anti-climb barriers along the Rio Grande. The logical concern should be why the Federal Government continues to hinder Texas’ ability to protect its border, all while allowing for the exploitation, dangerous, & inhumane methods of permitting illegal immigrants, including children, to illegally cross a dangerous river where many have lost their lives. Texas is the only state using every strategy & resource to protect its sovereignty, combat criminal activity, & discourage illegal immigration. #Texas will continue to hold the line.”

Works for me.  I think “Fuck you, feds” is in our state constitution somewhere.  If it isn’t, it could well be there after the next election.

Jokes aside, the interesting part of all this is a Constitutional one.

One of the primary functions of the federal government is to secure and maintain the nation’s borders against incursions from foreign nationals (hence the existence of a federal defense force and an immigration department).  If the federal government is failing in that duty, is it not the duty of the border states to fulfill that function?

Asking for a friend (in this case, TXGov Abbott).

And lastly, to the Supreme Court:

  1. I saw this yesterday and had your same reaction. A couple of senators are urging Biden to federalize the TNG in response, but I’m sure Abbot would order the commanding general (usually a 2 star) to refuse the order. And if he doesn’t, of all the state NGs, in Texas he should have no trouble finding a new CO who will before lunch.

    I noted the date, 01-24-2024. The secession–or a form of it–started on that date. I’m stocking up on popcorn! Should be interesting.

    They are NOT “failing”, they are deliberately encouraging and processing people across the border. They are committing treason.

  3. It’s pretty simple.

    Find a nice flat stretch of dry ground and install the razor wire.

    Plow the dirt in this side of the wire.

    Pump a bunch of water into the area, making it a nice muddy field, with at least a one foot mud depth.

    Then, set up cameras to record the border agents who have to come remove it.

  4. The Federal government has gone beyond neglecting their obligations. As Dan has said above, the current administration has been actively encouraging criminal migration.

    I think a few well placed marksmen could deter people from crossing the border illegally.

  5. well, many legislatures, governors, attorney generals of blue states and judges are ignoring the Bruen, Heller and MacDonald decisions by SCOTUS and they haven’t been taken to task at all. Sure they get spanked by SCOTUS but none of those creatures infringing upon our rights face any jail time, fines, legal fees, removal from office etc.

  6. Stand your ground Governor !
    Like JQ, I also thought of states, Calif for one, ignoring USSC decisions
    on so called ‘assault rifles’ etc. and being chided by us and others
    for doing so while at the same time we, Texas, decide to say ‘stuff it’
    defying a decision about national borders.
    We shouldn’t be having it both ways, but in this case I think it’s necessary.
    The decision – you can’t prevent immigrants, legal or otherwise, from
    coming in, INVALIDATES our border – ALL OF IT – in which case we
    NO LONGER HAVE A COUNTRY, PERIOD !!
    First, I Think this court has literally been bought, one way or another, money, favors, power, threats, pick one or more and therefore cannot be trusted to do what is right EVER AGAIN, at least until its makeup changes. They know
    damn good and well what is in the constitution as well as what is NOT in it
    but figure there is just NOTHING we can do about it if they simply ERASE OUR BORDER !! COMPLETELY !!
    On top of that staggering stupid thing to do, someone is over looking
    what I see as a LARGE CONSTANT STREAM ( RIVER ? ) of people who
    are NOT coming here to become Americans or work or LEARN THE DAMS LANGUAGE – they are, IMHO, coming here for the freebies !! Turn off the
    faucets of free housing, free food, free clothes, free health care,
    free education ( it their OWN LANGUAGE ) etc. etc. etc. and they will,
    for the most part, LEAVE on their own !

  7. Everyone (especially the media) is overstating what the SCOTUS said.
    Texas said, “we need an injunction telling the feds to stop cutting our wire while we go through this lawsuit instead of waiting for the lawsuit to finish.”
    SCOTUS said no. Nothing more.
    The SCOTUS didn’t say TX couldn’t use razor wire, they didn’t say that the Feds are allowed, they didn’t say anything other than, TX doesn’t get to act like it already won the lawsuit before the lawsuit even got started.
    Personally, I would give orders to TMD to follow CBP, and if they cut wire, put three more strands of wire behind them on the way out, boxing them in.

    This is why I think we should be studying and applying Principal and Agent law instead of this byzantine “Constitutional” Law. Among other things, it would emphasize that where the agent acts in contrary to the principal’s wishes, the agent may act, and is not deemed to have permanently surrendered the power to the agent, in this case the National government, the recipient of the specifically enumerated and specified powers delegated by the Constitution.

  9. SloJoe has alluded to calling up the Texas Guard under Title 10 orders. The only problem is the state Guard office has to approve the activation. Then there is the issue of lawful orders. Another twist is if the county sheriff’s deputized the Texas National Guardsmen that would throw another kink in the system.
